Terms of Service
These Terms of Service ("Terms") govern your use of the Flinkee platform ("Service") operated by Cushyfy Solutions Inc ("we", "us", "our"), a company registered in the Republic of the Philippines.
By accessing or using Flinkee, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Service Description
Flinkee is an AI-powered conversation intelligence platform that connects to your messaging channels (WhatsApp, Viber, Gmail, Slack, Telegram, and others), processes messages using artificial intelligence, and delivers structured briefings to your team via email.
The Service includes:
- Message aggregation from connected channels
- AI-powered summarization and briefing generation
- Scheduled delivery of briefings via email
- Admin portal for workspace and channel management
Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. Notify us immediately at support@flinkee.ai if you suspect unauthorized access.
Acceptable Use
You agree to use Flinkee only for lawful purposes. You must not:
- Monitor messages without consent — All participants in monitored channels must be informed that messages are being processed by Flinkee. You are responsible for obtaining and maintaining this consent.
- Use for surveillance or employee discipline — Flinkee briefings must not be used as the sole basis for employment decisions, disciplinary actions, or performance evaluations.
- Process illegal content — You must not use Flinkee to process, store, or distribute content that violates applicable laws.
- Reverse-engineer or abuse the Service — You must not attempt to access systems beyond your authorized scope, scrape data, or interfere with Service operations.
WhatsApp Disclaimer
Important: Flinkee connects to WhatsApp to read group messages for briefing purposes. You acknowledge and agree that:
- You are solely responsible for compliance with WhatsApp's Terms of Service and Meta's policies.
- You must use a dedicated business phone number — not a personal WhatsApp account.
- You must inform all group participants that messages are being processed by an external AI service.
- Cushyfy Solutions Inc is not liable for any account suspension, restriction, or action taken by Meta/WhatsApp as a result of your use of this integration.
Data Handling
Messages from your connected channels are:
- Transmitted securely to our servers via encrypted connections (TLS)
- Processed by Claude AI (Anthropic) to generate briefings — Anthropic does not retain your data for model training
- Stored in our database on Railway-hosted PostgreSQL with encryption at rest
- Retained per your plan (see Privacy Policy for retention periods)
- Deleted upon request or contract termination

Subscription & Payment
Plans: Flinkee offers Free, Starter, Pro, and Enterprise plans. Features and limits vary by plan.
Billing: Paid plans are billed monthly or annually in advance. All fees are in USD unless otherwise stated.
Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period. No partial refunds are provided for unused time.
Refunds: We offer a full refund within 14 days of your first paid subscription if you are not satisfied. Contact support@flinkee.ai to request a refund.
Intellectual Property
Your data: You retain full ownership of all messages, briefings, and data processed through Flinkee. We claim no ownership rights over your content.
Our platform: The Flinkee platform, including its design, code, and documentation, is the intellectual property of Cushyfy Solutions Inc. You may not copy, modify, or distribute any part of the Service.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party services (WhatsApp, Gmail, hosting providers).
Limitation of Liability
To the maximum extent permitted by law:
- Cushyfy Solutions Inc is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
- Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We are not responsible for the accuracy, completeness, or usefulness of AI-generated briefings. Briefings are summaries — not legal, financial, or professional advice.
Termination
We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination:
- Your access to the Service will be revoked
- You may request export of your data within 30 days
- After 30 days, all data associated with your account will be permanently deleted
Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved through arbitration in Makati City, Metro Manila, under the rules of the Philippine Dispute Resolution Center.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
